ALABAMA LIABILITY WAIVER AND HOLD HARMLESS AGREEMENT 

This Liability Waiver and Hold Harmless Agreement ("Agreement") is made and entered into by and between My Geek, LLC, Company ID 001-102-658, P.O. Box 3125, Hueytown, Alabama 35023 ("Service Provider"), and the undersigned client ("Client"), collectively referred to as the "Parties," effective as of the date signed below. 

1. Services Provided 
The Service Provider may perform installations, repairs, mounting, roofing work, and electronic equipment servicing, including PCs, laptops, mobile phones, and other electronics, as well as other related services ("Services") at the Client's premises located in Birmingham, Alabama, or other areas as agreed. 

2. Assumption of Risk 
The Client acknowledges and understands that the Services involve inherent risks, including but not limited to: 

  • Damage to ceilings, roofs, walls, furniture, floors, or other parts of the property 

  • Breakage or malfunction of electronic equipment 

  • Injury to persons or pets on the premises 

  • Accidental drops, scratches, spills, or other property damage 

  • Accidents caused during installation, maintenance, mounting, or roofing 

The Client voluntarily assumes all risks associated with the Services and accepts responsibility for protecting fragile property and electronics before work begins. 

3. Waiver of Liability 
The Client hereby releases, waives, and discharges the Service Provider, its owners, officers, employees, agents, and subcontractors from any and all claims, demands, damages, losses, or causes of action, whether known or unknown, foreseen or unforeseen, arising out of or in any way connected with the Services, including but not limited to: 

  • Property damage (including ceilings, roofs, electronics, walls, floors, furniture, and decorative items) 

  • Personal injury or illness 

  • Financial loss or inconvenience 

This waiver applies even if the Services are performed negligently, except in cases of gross negligence or intentional misconduct. 

4. Indemnification 
The Client agrees to indemnify, defend, and hold harmless the Service Provider against any claims, liabilities, damages, costs, or expenses (including reasonable attorney's fees) arising from the Services performed on the Client's property, including claims brought by third parties. 

5. No Warranties 
The Client acknowledges that the Service Provider makes no guarantees or warranties, express or implied, regarding the Services, the condition of the Client’s property, or the outcome of any installation, repair, or service. 

6. Compliance with Safety Instructions 
The Client agrees to follow all safety instructions and warnings provided by the Service Provider during the performance of the Services and to ensure a safe working environment. 

7. Governing Law 
This Agreement shall be governed by and construed in accordance with the laws of the State of Alabama. Any legal action arising under this Agreement shall be filed in the courts of Jefferson County, Alabama. 

8. Severability 
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. 

9. Entire Agreement 
This Agreement constitutes the entire agreement between the Parties regarding the subject matter herein and supersedes all prior agreements or understandings.
